Januar, folgende Ergänzung zur aktuellen Corona-Schutzverordnung veröffentlicht:

Sport mit 2G+ gilt nur für Innenräume!

In §4 (3) Ziff. 1 der CoronaSchVO hatte es hierzu in der Version vom 28.12.2021 zunächst eine etwas verwirrende Formulierung gegeben. Sie ist in der ab dem 30.12.2021 geltenden Version geändert worden und lautet jetzt: „(…) die gemeinsame Sportausübung (einschließlich Wettkampf und Training) in Innenräumen in Sportstätten sowie in sonstigen Innenräumen im öffentlichen Raum (…)“. Damit ist klar: 2G+ gilt nur für den Sport in Innenräumen, nicht für den Sport draußen.

Bei Sport in Innenräumen gilt 2G+ auch dann, wenn eine Maske getragen wird!

Beim Sport geht die Verordnung davon aus, dass das Maskentragen nicht praktikabel ist, und schreibt deshalb ausnahmslos 2G+ vor. Das heißt: Auch durch freiwilliges Maskentragen kann die Zugangsbeschränkung nicht auf 2G reduziert werden.

Auch Kadersportler*innen können eine Immunisierung übergangsweise durch PCR-Tests ersetzen!

Der übergangsweise Ersatz der Immunisierung durch einen PCR-Test (jeweils nicht älter als 48 Stunden!) gilt nicht nur für Teilnehmerinnen und Teilnehmer an Profiligen und an Ligen und Wettkämpfen eines Verbands, der Mitglied im Deutschen Olympischen Sportbund ist, sondern selbstverständlich auch für das Training von Bundes- und Landeskaderathleten*innen an Bundes- oder Landesstützpunkten, wenn sie dort für entsprechende Wettkämpfe trainieren.

Ligabetrieb innerhalb der Landesgrenzen ist keine überregionale Großveranstaltung!

4 (5a) der CoronaSchVO besagt, dass überregionale Großveranstaltungen nur ohne Zuschauer stattfinden können. Die Begründung zur CoronaSchVO sieht bundesweite Ligen als überregional an. Spiele der Fußball Regionalliga West sind demnach zum Beispiel keine überregionalen Großveranstaltungen. Damit kann dort die Kapazitätsregel des §4 (5) angewendet werden („Bei Veranstaltungen […] darf oberhalb einer absoluten Zahl von 250 Zuschauenden die zusätzliche Auslastung bei höchstens 50 Prozent der über 250 Personen hinausgehenden regulären Höchstkapazität liegen; insgesamt sind aber höchstens 750 Zuschauende, gleichzeitig anwesende Besucherinnen und Besucher oder Teilnehmende zulässig. Stehplätze dürfen nicht besetzt werden.“).

Reithallen sind unter bestimmten Umständen keine „Innenräume“!

Hierzu hatte es bekanntlich in 2021 unterschiedliche Auffassungen in der Landesregierung gegeben. Zwischenzeitlich ist geklärt: Reithallen, die zwar ringsum eine (etwa mannshohe) Begrenzung haben, ansonsten aber ringsum offen sind, zählen nicht als Innenräume. Bei wirklich geschlossenen Seitenwänden müssen aber mindestens zwei Seiten ganz offen sein, um nicht als Innenraum zu gelten.

Mit Blick auf die derzeitige Zugangsbeschränkung 2G+ in Innenräumen kommt einer grundsätzlichen Möglichkeit zu beaufsichtigten Selbsttests (für Kinder/Jugendliche während der Ferien; für Erwachsene jederzeit) in Sportvereinen hohe Bedeutung für den Vereinssport zu. Hierfür gibt es noch keine einheitliche, einfache Regelung. Wir sind hierzu in Kontakt mit der Landesregierung und hoffen auf eine rasche und vereinsfreundliche Lösung.

The transitional replacement of immunization by a PCR test (in each case not older than 48 hours!) applies not only to participants in professional leagues and in leagues and competitions of a federation that is a member of the German Olympic Sports Confederation, but of course also to the training of federal and state squad athletes* at federal or state bases, if they train there for corresponding competitions.

League competitions within the state borders are not major supra-regional events!

4 (5a) of the CoronaSchVO states that supraregional major events can only take place without spectators. The explanatory memorandum to the CoronaSchVO considers nationwide leagues to be supraregional. Games of the soccer league Regionalliga West, for example, are therefore not supra-regional major events. Thus, the capacity rule of §4 (5) can be applied there ("For events [...] above an absolute number of 250 spectators, the additional capacity utilization may be no more than 50 percent of the regular maximum capacity exceeding 250 persons; however, a total of no more than 750 spectators, visitors or participants present at the same time are permitted. Standing room shall not be occupied.").

Indoor riding arenas are not "indoor spaces" under certain circumstances!

As is known, there had been different opinions on this in the state government in 2021. In the meantime, it has been clarified: Riding halls that have a (approximately man-high) boundary all around, but are otherwise open all around, do not count as indoor spaces. However, if the side walls are truly closed, at least two sides must be completely open to not count as an indoor space.

In view of the current 2G+ indoor access restriction, a fundamental possibility for supervised self-testing (for children/youth during vacations; for adults at any time) in sports clubs is of high importance for club sports. There is still no uniform, simple regulation for this. We are in contact with the state government and hope for a quick and club-friendly solution.
